However, right is a contested concept, and any discussion of it requires theorizing. Despite offering different views about the nature of right that can be categorized under two theories named will-based theory and utility-based theory, it seems that we can recognize the claim-based theory as a comprehensive conceptual theory about right. According to this theory, right is a guaranteed individual claim that has been justified based on two elements of human dignity and moral agency. Any way can we defend the nationality as a human right? In this article we will attempt to show from a descriptive and analytic perspective that nationality is one of the fundamental human claim rights and moreover is the precondition of all rights. The non-recognition of the nationality as right will directly lead to denial of intrinsic dignity and moral agency and therefore deprivation of humanity.}, keywords = {Claim-right,Intrinsic dignity,Moral agencyو Nationality,right}, title_fa = {حق بر تابعیت؛ از حقوق بین‌الملل خصوصی تا حقوق بشر}, abstract_fa = {مفهوم حق به مثابة یکی از مفاهیم بنیادین حقوق، سیاست و اخلاق، راه خود را به گفتمان حقوقی جامعة ایرانی نیز باز کرده است. با این حال، مفهوم یادشده، مفهومی مناقشه‌آمیز بوده و هرگونه بحث دربارة آن مستلزم ورود به عرصة نظریه‌پردازی است. به رغم بیان دیدگاه‌های متفاوت در زمینة ماهیت حق که ذیل دو نظریة اراده‌انگار و سودانگار قابل دسته‌بندی‌اند، به نظر می‌رسد می‌توان نظریة مطالبه‌انگار را که به موجب آن، حق، ادعای فردی تضمین‌شده‌ای است که بر اساس دو عنصر کرامت ذاتی و فاعلیت اخلاقی توجیه‌شدنی است، جامع نظریه‌های مفهومی رقیب دانست. پرسش آن است که آیا می‌توان بر مبنای نظریة مزبور و با تکیه بر مبانی توجیه‌کنندة آن، از ادعای فرد بر داشتن تابعیت در معنای مورد بحث در حقوق بین‌المللی خصوصی ذیل عنوان حق دفاع کرد؟ در این مقاله تلاش شده است با اتخاذ رویکردی توصیفی- تحلیلی نشان دهیم برخورداری از تابعیت، یکی از حق‌ادعاهای بنیادین انسانی است و افزون بر این، پیش‌شرط برخورداری از همة حق‌هاست. بر این اساس، عدم شناسایی تابعیت به مثابة حق به‌طور مستقیم، به انکار کرامت ذاتی و فاعلیت اخلاقی و در نهایت، به سلب انسانیت انسان منتهی خواهد شد.}, keywords_fa = {تابعیت,حق,حق- ادعا,فاعلیت اخلاقی,کرامت ذاتی}, url = {https://jolt.ut.ac.ir/article_55637.html}, eprint = {https://jolt.ut.ac.ir/article_55637_9297c1e227ec7521a6b5521e7b97d9f7.pdf} }
