The aircraft lease agreement, as one of the key instruments in the aviation industry, plays a crucial role, particularly in financing and managing the air fleet. This type of contract allows airlines to expand their fleets effectively without the need for substantial investments in purchasing aircraft, thereby enabling them to manage their operational costs more efficiently. In Iranian law, aircraft lease agreements are utilized within the frameworks of international norms for the operation of these vehicles. This article analyzes the legal aspects of aircraft lease agreements within the Iranian legal system and compares them with certain other legal systems. The types of aircraft leases include wet leases and dry leases. Given the importance of these contracts in facilitating economic activities, this research can contribute to a better understanding and improvement of the legal status of aircraft lease agreements by offering practical suggestions, such as accession to the Cape Town Convention on Mobile Equipment and the development of relevant legal knowledge, including the establishment of specific regulations regarding aircraft leasing. موضوع تأمین مالی برای شرکت‌های حمل‌ونقل هوایی همواره پر چالش و مبتلابه است. قرارداد اجارة هواپیما به‌ عنوان یکی از ابزارهای کلیدی در صنعت هوانوردی، به‌ویژه در تأمین مالی و مدیریت ناوگان هوایی، نقش بسزایی ایفا می‌کند. این نوع قرارداد به شرکت‌های هواپیمایی این امکان را می‌دهد تا بدون نیاز به سرمایه‌گذاری‌های کلان برای خریدِ هواپیما ناوگان خود را توسعه دهند و به ‌طور مؤثری هزینه‌های عملیاتی خود را مدیریت کنند. در حقوق ایران، قرارداد اجارة هواپیما تحت چارچوب‌های مرسوم بین‌المللی و برای بهره‌برداری از این وسیلة نقلیه به کار می‌رود. این مقاله به تحلیل حقوقی قراردادهای اجارة هواپیما در نظام حقوقی ایران و مقایسة آن با برخی نظام‌های حقوقی می‌پردازد. انواع اجارة هواپیما عبارت از اجارة تر و خشک و تأمین مالی است که با توجه به اهمیت این قراردادها در تسهیل فعالیت‌های اقتصادی این تحقیق می‌تواند با ارائة پیشنهادهای عملی از جمله الحاق به کنوانسیون بین‌المللی راجع به تجهیزات متحرک (کیپ تاون) و توسعة دانش حقوقی مرتبط، مانند وضع مقررات خاص در خصوص اجارة هواپیما، به درک بهتر و بهبود وضعیت حقوقی قراردادهای اجارة هواپیما کمک کند. https://jolt.ut.ac.ir/article_104460_48574a729c1253f7c1bfaf17ce40cccf.pdf
