The right of retrait, a moral right of authors within literary property law, permits the author to withdraw a published work from the assignee. While this right is practically enforceable in Romano-Germanic legal systems like France and Germany, contingent upon assignee compensation for damages and a genuine change in the author’s convictions (not mere taste or financial gain), it is not independently recognized in common law jurisdictions. Despite its absence in Iranian law and scholarly objections to its adoption, this study argues for the incorporation of the right of retrait into Iran’s intellectual property framework. Employing a descriptive-analytical methodology grounded in documentary and library research, the paper reviews relevant literature, analyzes findings based on intellectual property principles, and proposes legislative recommendations for the Iranian lawmaker, suggesting a pathway to balance authorial moral rights with existing legal structures and public interest considerations.
