Natural Monopoly and Third-Party Access Right in Investment in Oil and Gas Pipelines with Emphasis on UK Law

Abstract

Oil and gas pipelines have a Natural Monopoly. This fact results in prohibiting new investment in this sector of industry. However, identifying the right of Third-Party Access to existing oil and gas pipelines is an essential issue to diversify new markets. With the implementation of the general policies of Article 44 of the Constitution of Iran, the prohibition of private sector entry into Iran's economic activities was lifted to some extent; Despite the emphasis on attracting new investment in Iran's Oil and Gas macro policies and upstream documents, the concepts of Natural Monopoly and Third-Party Access, have not been decently considered. The experience of other countries is functional in this regard. Considering Natural Monopoly and Third-Party Access principles, in this article, it has been tried to definite these concepts. Besides, by emphasizing on these two crucial concepts, it has been endeavored to derive appropriate benefits from the experience of investing in oil and gas pipelines in the UK.
