Abstract

Philosophical and theological principals can have various in different realms. In this essay it will be discussed quality of influent of spenoza’s philosophy in criminal law and punishment of crime’s. Firstly for this purpose each whoud be discussed philosophical view of Spinoza and also it influent in ethics and duty. On the basis of philosophy and philosophy of ethics of Spinoza we view of philosophy of criminal law.
Spinoza was a deterministic philosopher who denied free will. He introduced analytical and descriptive ethics in place of preaching one and denied for guilty person legislative right of punishment and proved creative right. For Spinoza, society for immune of harms of evil persons has their right of punishment. Not in respect of what that they have entitled punishment. Degree of punishment must be suit to the very view.
