Abstract

The rapid development of physiology and medical sciences and growth of accessibility to cure the infertility has raised many complicated questions as regards ethics, law, sanitation, psychology and religion- the ones which are looking to religion ministers and logicians for prompt and suitable solutions; so that the way for a constructive and comprehensive legislation can be paved.
One important relevant question in the field of legal issues is the inheritance status of the infants conceived by the means of donating sperm, donating ovule or the fetus itself. Another question remains unsolved regarding the frozen fetus, or the born infants whose embryos have been fertilized after the donator’s death; whether, like normal infants, their inheritance share must be approved and saved; if yes, how long the time limit has to be.
In the present article, an attempt has been made to find appropriate answers, on basis of the general Islamic jurisprudence and legal regulations, as well as legal thoughts and jurists' opinions, to the questions arisen in respect of inheritance of lab infants
