The judge’s knowledge is one of the evidences by which a crime may be proved and that it may take precedence over others. In this article, the arguments in favor of those who believe that a sentence can be based on the judge’s knowledge will be discussed and the arguments of opponents will be reviewed. The arguments in favor of judge’s knowledge will then be supported without any difference between the Allah rights and people rights. Our support and argument is based upon the consensus of jurists, priority of knowledge to evidences and other Islamic texts which require judges to sentence according to real facts
