Abstract

With the increasing development of social life dimensions, the rise of rural and urban population rate, the high rate of development and construction, together with partly the interference and disturbance of persons’ rights and the arising of many registration problems for the citizens and their expectation of the existing registration rules and regulations to secure their legal and legitimate rights, it is indispensable for the jurists to be aware of the rules and regulations concerning the document and property registration, to be well familiar with the rights and responsibilities stipulated therein.
In this article, one of the financial rights entitled “the Right of Standing Property” and its status in the Registration Law and also various claims arising from it, is reviewed. The owner of the right of standing property, who is, in fact, the owner of the constructed building on the site belonging to another, has the right of the reconstruction and conveyance of the building to another, and is also authorized to obtain the registered title deeds. Although this is a preliminary study, it can be deemed to the reader as a starting point for more extensive and in-depth investigations
