Contemporary enhancement of medical sciences along with the possibility of cure for barrenness via (ART) made hope for many barren couples; so that, the technique was soon warmly received by infertile couples all over the world. The new situation has raised certain questions in respects of morality, legal, sanitation, social, psychology and religion status. Consequently, comprehensive supporting laws have to be passed to regulate different aspects of dedicating foetus to an infertile parent. In Iran, a legislation was approved by the Parliament on 8/5/1382 on the way of dedicating a fetus to infertile couples. Subsequently its executive by-law was approved by the Board of Ministers and published in the same year. Although the above legislation was a step forward in resolving the legal difficulties of infertile couples, it suffers from some considerable defects and shortcomings. The present article is an attempt to demonstrate the weak and strong points of the legislation and to provide certain suggestions for its possible improvement.
