عامل ارتباط در شناسایی قانون حاکم بر قراردادهای اموال فکری

چکیده
امروزه جهانی‌شدن خصوصاً در بخش سرمایه و دارایی، همة عرصه‌های دانش حقوق را تحت تأثیر قرار داده است. حرکت به سمت قراردادهای خصوصی در روابط فراسرزمینی و تنظیم حجم زیادی از قراردادهای نمونه و استاندارد در روابط افراد شاید تا حد زیادی شاخة حقوق بین‌الملل خصوصی را به حاشیه رانده است. اما حقیقت این است که بدون درنظرگرفتن خطوط اصلی این شاخه از دانش حقوق نمی‌توان به توافقی راهگشا دست یافت که همة اختلاف‌ها یا دست‌کم بخش اصلی اختلاف‌ها را پوشش دهد. به‌اضافه یک قرارداد هرگز نمی‌تواند همة جنبه‌های اختلاف را پیش‌بینی کند و در برخی موارد نظام‌های حقوقی با وضع قوانین آمره در موضوع، جلوی توافق را سد می‌کنند. این مسئله به‌ویژه در اموال و مالکیت معنوی به‌واسطة برخی ویژگی‌های ذاتی و برخی کنوانسیون‌های ناظر به این اموال، دشواری‌هایی ایجاد می‌کند. این پژوهش درصدد است به عامل ارتباط با درنظرگرفتن ویژگی‌های اموال و مالکیت معنوی، در حوزة قراردادهای مربوط به این اموال، نگاهی موشکافانه داشته باشد.

Connecting Factors in Identifying the Law on Intellectual ‌Property Contracts

چکیده English

These days globalization especially in the capital and property parts has impressed all fields of the Law. Moving towards private contract in overseas relations and adjusting the volume of standard contracts in relationships maybe largely elapsed the field of international private law. But the truth is that regardless of the main lines of this field of law achieving an agreement which is covering all or at least main part of differences is impossible. In addition, a contract can never predict all aspect of differences and in some cases law system with mandatory laws on the subject will dam the agreement. This issue especially in intellectual property due to some inherent features and some related conventions to these properties creates difficulties. This article seeks to speculate the connecting factors considering the characteristics of the intellectual property in the scope of related contracts.
