چکیده

قیمت‌گذاری محصولات و خدمات از ابزارهای اساسی رقابت و یکی از شروط لازم برای یک بازار رقابتی، حق تعیین قیمت به صورت آزادانه برای بنگاه‌ها است. حقوق رقابت در بسیاری از کشورها قیمت‌گذاری تبعیض‌آمیز را جزء رویه‌های ضدرقابتی اعلام کرده است، در حالی که تحلیل‌های انجام‌گرفته، به‌ویژه در حوزة حقوق مالکیت فکری نشان می‌دهد بسیاری از اشکال تبعیض قیمت علاوه بر اینکه آثار مخرب بر رقابت ندارد، ممکن است سبب ارتقای رفاه و کارایی اقتصادی شود و منافع آن بیش از زیان‌هایی است که ممکن است ایجاد شود. در حوزة حقوق مالکیت فکری نظام‌های مختلف از جمله ایالات متحدة آمریکا و اتحادیة اروپا و ایران رویکردهای متفاوتی اتخاذ کرده‌اند.

چکیده [English]

Pricing of goods and services are one of the fundamental instrument of competition and
prerequisite for a competetive market is the right to determine prices freely by undertakimgs. Competition Law has declared discriminative pricing as an anticompetetive practices in many jurisdiction while analysis specially in the scope of Intellectual property rights shows that many form of price discrimination dont have destructive effects on competition but cause increase of walefare and efficiency and their benefit are more than their detriments. In the field of intellectual property, legal systems such as EU,USA and Iran take different approaches.
