مطالعة تأثیر قواعد حقوق مالکیت فکری بر هزینة معاملات همکاری‌های علمی بین‌المللی

چکیده

در نتیجة تغییر سیاست‏ها و قوانین و گسترش حمایت‏های قانونی از مالکیت‏ فکری، مبتکران با موانعی جهت همکاری با همتایان خود در کشورهای دیگر، از جمله کسب رضایت ذی‌نفعان و نامشخص بودن وضعیت حقوقی، روبه‌رو شدند. در این تحقیق طرق رفع موانع همکاری‏های علمی بین‏المللی ناشی از قواعد حقوق مالکیت فکری مطرح و این نتیجه حاصل شد که راه‌حل‌های متنوعی در این خصوص پیشنهاد شده که مهم‌تر‏ین آن‌ها تلفیق ابزار‏های پیشرفتة فنّی، مانند قرارداد‏های هوشمند با مبانی مالکیت سنتی، بوده ‏است که می‏تواند راهنما‏ی خوبی برای همکاری هر چه بیشتر حقوق و راه‏حل‏های سنتی و فناوری برای کاهش موانع همکاری به حساب آید.

چکیده [English]

Due to policies and laws changes and territorial legal protections expansion, researchers have encountered obstacles to collaborate with other researchers in other countries including regarding stakeholders’ satisfactions and the vague legal status. In the research, an attempt was made to analyze the required measures for removal of international scientific collaborations obstacles. The most important solution in this area so far were combining advanced technical tools such as smart contracts with the principles of property to reduce transaction costs which can be a good guidance practices to cooperation as much as possible between law, traditional solutions and technology to reduce transaction cost.
